Terms of Service

This Terms of Service agreement applies to all client galleries delivered through the domain: thecrypt.monsterofnone.com (the "Gallery Site") operated by Monster of None Photo ("Photographer," "we," or "us").

By accessing your gallery, downloading images, or placing print or product orders, you agree to the following terms.

1. Ownership of Images

All photographs and digital files are protected by United States and international copyright laws. Monster of None Photo retains full copyright ownership of all images unless otherwise stated in a written contract.

Clients are granted a limited-use license as described in their individual session agreement.

2. Permitted Use

Unless otherwise stated in your contract, delivered images may be used for:

• Personal use including social media sharing, printing, and personal websites

• Portfolio use by subjects featured in Creative Portrait sessions, with credit to the Photographer

3. Prohibited Use

Clients may not:

• Sell, license, or commercially profit from images without written authorization

• Alter images in a way that misrepresents the Photographer’s work, including heavy filters or AI modification (cropping for social media is acceptable)

• Submit images to media, publications, contests, or advertisers without written permission

• Use images for AI datasets, NFTs, or similar technologies without written permission

Branding and Event clients may receive expanded commercial usage rights according to their contract.

4. Gallery Access and Expiration

Client galleries remain active for six months unless otherwise stated. After the expiration date, the Photographer may charge a gallery reactivation or archival fee for file retrieval.

Clients are responsible for backing up images after delivery. The Photographer is not responsible for lost files after gallery expiration.

5. Image Delivery and Quality

Images are delivered in high-resolution JPEG format. Color and exposure may vary depending on screen calibration and third-party print labs. The Photographer recommends ordering prints through the integrated store for optimal quality.

6. Print Store Purchases

Products purchased through the integrated print store are fulfilled by professional third-party labs. All sales are final except in cases of production defects. Issues with prints from non-affiliated labs are not the responsibility of the Photographer.

7. Refunds and Cancellations

Due to the nature of digital products and custom art, no refunds are offered once images are delivered. Requests for technical corrections must be made within seven days of gallery delivery.

8. Privacy and Security

Public and unprotected galleries may be shared at the client’s discretion. The Photographer is not responsible for unauthorized access if a client shares their gallery link.

9. Model Release and Portfolio Use

If a signed model release is on file, the Photographer may use images for portfolio, website, print, marketing, or promotional purposes. Clients without a signed model release will remain private.
